By accessing or using the Settle platform located atsettleva.com(the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and Settle Real Estate, LLC, a Virginia limited liability company (“Settle,” “we,” “us,” or “our”).
We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
The Platform provides real estate search tools, property valuations, agent matching services, market data, and related resources for the Commonwealth of Virginia. You may use the Platform solely for lawful purposes related to buying, selling, renting, or investing in real property.

Certain features of the Platform require you to create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify Settle immediately if you become aware of any unauthorized use of your account or any other breach of security. Settle will not be liable for any loss arising from unauthorized use of your account where you have failed to maintain the security of your credentials.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.
Property listings, valuations, market data, neighborhood statistics, school information, and other real estate data displayed on the Platform are provided for informational purposes only. While we strive to ensure accuracy, Settle does not warrant or guarantee the completeness, accuracy, or reliability of any property information displayed on the Platform.
Automated valuations generated by the Platform are estimates based on available data and algorithmic models. They are not formal appraisals and should not be used as the sole basis for any financial or real estate transaction. We strongly recommend that users obtain professional appraisals, inspections, and legal counsel before making any real estate decisions.
Listing information may be sourced from multiple listing services (MLS), public records, and third-party data providers. Information may be subject to change without notice. Settle is not responsible for errors or omissions in listing data provided by third parties.
All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio, video, data compilations, software, and the overall design and arrangement of the Platform, is the property of Settle or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
The Settle name, logo, and all related marks are trademarks of Settle Real Estate, LLC. You may not use any of our trademarks without prior written permission. Nothing in these Terms grants you any right, title, or interest in the Platform or its content beyond the limited right to use the Platform in accordance with these Terms.
If you submit content to the Platform (such as reviews, photos, or feedback), you grant Settle a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, distribute, and display that content in connection with the operation of the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SETTLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM.
Settle does not guarantee the outcome of any real estate transaction facilitated through the Platform. Real estate transactions involve inherent risks, and you acknowledge that you are solely responsible for evaluating the merits of any transaction. Settle is not a party to any real estate transaction between users and is not liable for any disputes arising between buyers, sellers, agents, or other parties.
IN NO EVENT SHALL SETTLE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT YOU HAVE PAID TO SETTLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Platform shall be brought exclusively in the state or federal courts located in the Commonwealth of Virginia.
You consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue of any such action or proceeding in such courts. Any claim arising out of or related to these Terms must be filed within one (1) year after the cause of action arose, or the claim is permanently barred.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. The failure of Settle to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
